In the press, it is common practice to reproduce information from competitors. This thesis examines the extent to which the reuse of press articles is permissible under copyright and related rights law. In doing so, it acknowledges the intellectual property law principle of freedom of information. Furthermore, the thesis analyses the extent to which the Urheberrechtsgesetz (Copyright Act) permits the reuse of press articles by generative artificial intelligence. The author concludes that the application of the text and data mining exception violates the three-step test in certain cases. She calls for the introduction of an appropriate remuneration scheme for the commercial reuse of works for the purpose of training and applying generative AI systems.
