Art. 14 Digital Services Act explicitly links the drafting, application and enforcement of platform terms and conditions to fundamental rights standards. This study analyses the provision as a form of regulated self-regulation and situates it within the existing framework of contract law and fundamental rights.

It focuses on how transparency, proportionality and rights-based balancing operate as overarching principles. The study shows that Art. 14 DSA does not replace existing control mechanisms but develops them further and adapts them to multipolar constellations. By incorporating fundamental rights considerations, the balancing of interests shifts towards a structured and reviewable decision-making process, thereby shaping the future application of platform rules.
